Legal Question in Consumer Law in California

sold car to dealer but dealer dosen't pay off lien

I sold my car on Dec 31 to a dealer, at that time I owed about 12000 on the car.

I sold the car for 12400, got a check for 400 from the dealer and the dealer told

me he will pay off the car to my financing company. As of today, Jan 24, the car

is not paid off and I get calls from my financing company. I called the dealer but

they say they will pay it off soon. What can I do. I want to avoid any negative

report in my credit history etc.

File a comlaint against the dealer with the Department of Motor Vehicles. After you file the complaint with the DMV, send a copy to the dealer along with a letter that says you are going to hire an attorney and sue them if they don't pay off the lien within 7 calendar days. Send a copy of the letter and the complaint form to the finance company. If that doesn't work, consult a local attorney for further assistance.
