Legal Question in Consumer Law in California

My son was invited to go on a Hawaii trip with his HS water polo team for the summer.

We never signed any paper work about Deposits not being refundable. We made the checks out to a travel agency and they cashed them. 6 weeks before the trip we've had to cancel and have paid a total of $850 towards the trip. The coach said the money is non refundable when I told him that we can't go, plus they already found a kid to go in his place that is paying also. Again, I never signed anything except a consent to treat in case of injury for my son, and was never at anytime told this is nonrefundable. Is it the school I go after, the coach or the travel agency I made the checks too and they cashed?

Travel expenses are often non-refundable, especially airfare, except when there are special circumstances. Generally, the airline will give you a voucher for travel on another date. Although you did not sign anything, you probably agreed to some terms relating to the trip. They may be through the school, the team, the coach and/or the travel agency, and by signing the consent form and making payment, you may be held to have consented. Those terms would need to be reviewed to determine what you are entitled to. Ask for them and start there.
