Legal Question in Consumer Law in California
My son purchased a car 2 weeks ago, and we went and got liability and uninsured motorist. Within the month someone hit my sons car in front of the school and witnessed by 3 teachers and a couple of neighbors. . We went to the insurance company to file a claim and was told that because I didn't catch the driver of the car that they wouldn't honor the policy also, the school teachers got the license plate of the car the agent told me the car came back as a honda, (the teachers said it was a BMW) Its been 3 weeks since the accident and they are still refusing to honor the claim. Please help with a solution. Thank You

Of course they are refusing the claim. They're an insurance company. If your son was injured, get medical help as necessary and call a lawyer. If there were no injuries, you should demand arbitration from your insurer, and also write to the state insurance commissioner.
Did you file a police report and provide that to the insurance company? It is not surprising that the insurance company is resiting paying the claim; however, if you are persistent they will typically comply. What is their stated basis for denying the claim?
