What is the Statue of Limitations
My husband and I are being sued for breaking a apartment lease. We have been out of that apartment now for 8years and 5 months. They are taking us to small claims court, what is the statue of limitations.

Generally, the statute of limitation for breach of a written contract (i.e., a written apartment lease) is four (4) years. If you have not lived in your apartment for "8 years and 5 months," you should have no problem proving to any small claims judge that the statute has run, and the plaintiff is not entitled to anything.
