Legal Question in Consumer Law in California

Tenant Renting

I have rented a townhouse for two months now and they sent me a letter stating that next month they are raising the rent $50.00 more a month. Is this legal? What can I do about it?

Re: Tenant Renting

The answer to our question depends on the terms of lease. For example, if you had a 6-month lease for $1000 per month, the couldn't just simply raise your rent unless there was a clause in the lease that allowed for an adjustment for some reason. If you are on a month-to-month lease, then the landlord can modify any of the terms of the lease on 30 days written notice. If your lease also makes you responsible for paying the HOA dues as part of your rent, then you might be responsible if there was an assessment increase by the HOA.

Also, you might be subject to a local rental control law. Therefore, it is extremly important for you to contact a local attorney to discuss your situation.
