Legal Question in Consumer Law in California
Tom assists his friend to advertise a second hand car in the internet. for $20,000. The advertisement says that the car is brand new, and Tom honestly believes it to be true.Harry sees the advertisement and of himself 'what a great deal!' He calls Tom and offers to buy the car immediately in cash. The parties meet up on the same day and Harry pays Tom and takes delivery of the car without bothering to check whether the car is in fact brand new or not. Harry later discovers that the car is second hand and that Tom's advertisement is false.
Can Harry return the car to Tom and get a refund? If yes give reason why.

No, because Harry didn't do his own homework when he was in law school or a legal studies class, just like you are trying to do now.
