Legal Question in Consumer Law in California
I had a transmission rebuild completed in January (the shop had my car 84 days I contacted Cali BAR and they didn't feel 84 days was to long to do the repair(09 Buick Lucerne) The 6 month warranty is up and the tranny went out. Another shop told me after they opened it up that the wrong tranny kit was used. I have a statement from the mechanic. The tranny was rebuilt in less than 10 days. Can I sue the first mechanic faulty repair and the cost of the new rebuild. Can I also sue for the 84 days the first mechanic had my car. I am considering small claims.

You can ask for whatever you want. It will be up to the judge to determine if you submitted enough evidence to establish your case. If the first shop did not do the repair properly, you can sue for the costs of the second repair. You may be entitled for loss of use for the 84 days.
