Legal Question in Consumer Law in California

travel agency misinformation - ticket cancellation

I booked air ticket to fly from dallas to london from a ticketing agency in california.they sent me a ticket with transit at toronto(canada)in air-canada airlines. But on the day(dec23rd)of travel at check-in, the airlines people didnot allow me to board saying that I should have a transit visa(for indian passport) before hand to transit via toronto. When I contacted my ticketing agency ,they are trying to blame me that i should have taken canada visa and it's my fault.Actually my request was to london and i have UK visa. The transit schedule was given by agency. Now they say that they will charge 250$ to cancel the ticket and also they say it all depends air canada airlines for partial refund. When i contacted air canada airlines , they said they dont charge if it is unused ticket and in this case it is problem of ticketing agency for not letting me know about transit requirements.this travel agency's check list doesnot have any visa requirement details and all.'am losing my vacation, christmas gathering, also my money.what shud i do to get my money and compensation from that agency?

Re: travel agency misinformation - ticket cancellation

It is generally the responsibility of the traveler to ensure that he or she has the proper visas as for travel. Unless the travel agency did something to mislead you, such as telling you that you did not need a particular type of Visa, then they would not be responsible.
