Legal Question in Consumer Law in California

Unhappy With Engagement Ring

I bought an engagement ring that keeps turning

black. The jeweler from whom I purchased it from

and other jewelers have said that a platinum ring

should not do this; platinum doesn't oxidize. We

have taken the ring back to the jeweler four times,

she has cleaned it, had it tested to be sure it was

platinum, and made recommendations to keep it

clean. My fiancee has followed all

recommendations and the ring turned black

again. We have asked for and were denied a

refund. All sales are final according to the jeweler.

Do we have the right to get a refund? If so how

would we go about doing so? Thank you for your

time. . .

Re: Unhappy With Engagement Ring

Have the ring checked by an independent jeweler. It sounds like you did not get platinum despite the selling jeweler's representations.

If it turns out that your independent jeweler confirms no platinum then you can bring a lawsuit against the selling jeweler for fraud and breach of contract. Depending on the value of the ring you may be able to bring a small claims suit, Municipal or Superior Court.

Give a call if you would like to discuss this.
