Unlicensed contractor filed lien and more
I hired a contractor using a relatives license claiming to be licensed. We didn't get what was agreed to, horrible workmanship, broke a $2500 glass range, damaged $2500 range hood wouldn't return my calls so I cancelled 2nd payment of 3 (never issued 3rd) he filed a lien. I filed a bond claim and complaint w/ CSLB, found out he's not licensed and won bond claim -$6k to fulfill contract obligation. He repeatedly refused to remove lien more so after the cease and desist order, and he blames me completely. File an exparte in pro per to get lien ordered removed but forgot to include certified copy of lien. 1 day prior to the next court date he released the lien - likely in an effort to prevent me from recovery of costs. My home value depreciated approx $300k duriing all this and at least 1 likely 2 sales fell thru as a result. Now I want to sue him for abuse of process, slander of title, fraud, recovery of the $7k consideration he received (amount of contract $7k) pursuant to B&P7031(b), fraudulent misrepresentation, intentional infliction of emotional distress, breach of contract, etc. Does such a case have any merit in civil court?
