Valet left keys in vehicle on street vehicle was stolen
Hi,
We parked our car in valet last week to go skiing. We gave the keys to the valet driver. He put the keys back in the car and went to park another car. When he came back, the car was gone. He assumed we came to pick up the car even though we had given him our money, a tip, and he had given us the claim stub in return. We came back 6 hours later and that is when we realized it had been stolen. We reported it and ended up finding it the next day. We also called the claim number and finally heard back 3 days later. We lost our vacation and a lot of items from the car...not to mention the cost for a new key, rekeying our apartment, towing, and rental car. We don't think we should go through our insurance...don't want a premium increase, plus auto doesn't cover items in vehicle. We have a signed claim form from his manager stating the keys were left in the car. We gave the claim stub back. Can we go to small claims and collect not only on items but on lost vacation time (PTO, etc)?

Yes. You're limited to $7,500 under the new law.
