Legal Question in Consumer Law in California
I had my van painted at a locol body shop last month, when I got it back it had excessive orange peel in the paint, streaks in the hood and they sanded off part of my business name on the back winows of the van, they also used a black marker on the sides of the van to try to cover up over spray by the windows. I took it back and pointed out all of the problems with the paint they said they would re-do the paint, after the second time I got the van back the paint didn't change it still had excessive orange peel in the paint but this time they sanded off the glossey black paint in between the windows of the van and painted it flat black and dented my roof and the paint is peeling off of the van where they didn't sand and now there are dark streaks on the sides of the van and still some on the hood. I called there corporate office they came out and looked at it didn't really say anything at all, then said we will repaint the van again. I told him I don't want them to work on my van again, I'll have some one else do the paint again when I am able to do it just refund my money and we will call it done. The rep called me back and told me go get my van repainted (basicly now) show me that it was repainted and then I will refund youre money or I'll give half of youre money now then when you get it repainted I'll give you the other half, I told the rep thats not how it works, I don't have to get my van repainted now in order for you to refund my money for there bad workmanship, he then replied this is how its going to work, if I give you all of youre money back now you wont repaint youre van we both know it, I then asked him are you going to reimburse me for the dents in my roof and for the business name they sanded off of my van, he then told me no and prove we did it. All the rep kept telling me was repaint the van again then I'll refund youre money because we are out materials for the paint job. I'm in business also he knows this, I told him if I did an interior on a customers car gave them a bad job and damaged the car in the process I would have to reund there money repair the damage and eat the cost of the materials, not tell them to go spend more money at a nother shop then I'll refund your money. He replied thats how youre going to get youre refund, youre van looks better than it did so be happy with that. My van is not a pile of crap I have it seviced when it needs it at my locol dealerships I use factory parts when needed, I take pride in my vehicles because they represent me and my business and for this companey to talk and treat me like some low life has really got me bent.( Also my warranty changed from 3 years to 1 year and they charged for color change, there was no color change the van was gray and I had it repainted back factory gray.) Whats my next move from here. I know I can take them to small claims but with my business its hard to just shut down for a hole day and lose money over this. There trying to force me to spend more right now in order for them to refund my money.

If all the damage is $10,000 or less, or you would accept $10,000 or less, sue them in small claims court. It sounds like they deserve it.
