Legal Question in Consumer Law in California

Verbal Contract with Clergy Network

We hired an officiant to perform our marriage four months prior to the wedding date. During our first meeting with the officiant, we asked what the fee was to perform the marriage and the amount of $400.00 was discussed. There was never any paper copy during the first visit. One week later we called the company and told them we would like to hire them and we paid by credit card. they said that we should receive a confirmation within a couple of weeks. A little over two months prior to the wedding date, we called the company, asked to cancel their services, and requested a refund. They refused to refund us, and stated that they told us the fee was non-refundable. We also stated that we had never received a confirmation. Two days later we received a confirmation by mail which stated many times that the fee was non-refundable. I called them again to try to come to a resolution, but they would not compromise. What are our chances of fighting for our money back in court? Can we state that they had misrepresented their policy?

Re: Verbal Contract with Clergy Network

Your best bet is to sue this company in small claims court. You should win this one. They are counting on the fact that you will not do anything. Fool them and sue in small claims court.
