Legal Question in Consumer Law in California
Warranty issues
The brand new car I purchased from a local dealership in October of last year came with after-market wheels.
I recently had a flat tire and when I took the tire off, I found that it was severely cracked in a way that seemed unnatural. I took the wheel to the dealer for options on getting the wheel replaced. The distributor whom they purchased the wheel from said that the manufacturer will not cover the wheel under warranty due to ''the owner'' causing the damage by ''hitting something''.
The dealership will not cover the wheel under warranty either. I did not ''hit anything''. I took it to several wheel dealerships and every single person that looked at it had never seen anything like it. After hearing these opinions, I find it hard to believe that something like this could happen if the wheel was not a defective product.
Customer service of this [Company], says that I have to settle this with the dealership I purchased the car from. Since the wheels were not the original wheels that came with the car, there was nothing to be done from their end.
I have tried contacting the manufacturer but have not yet received a reply.
Could you possibly direct me on how to deal with this problem?

Re: Warranty issues
The manufacturer is not liable for this. However, both the dealer and the tire mfg. are liable. The only way for you to collect is to sue both of them in small claims court. Good luck.
