Legal Question in Consumer Law in California
Hi i won my settlement but i wasnt the prevailing party.Lawyer has been fighting with the prevailing party for his fees.The court told him that the prevailing didnt have to pay his fees.Can my lawyer keep my settlement check untill he gets paid.

The answer depends upon the how the retainer agreement between you and your attorney reads. You need to review that document carefully, and maybe seek a consultation from another lawyer as to his opinion, as you may have an action for recovery against your lawyer for withholding payment your settlement to you, as the fee agreement may not provide the lawyer the right to retain your settlement for payment of his fees..
