Wrongful monthly charges from bank going back years.

I have just learned that my bank has been charging me a ''special

handling fee'' each month for the past several years. This was not a fee

that I ever approved of, certainly not in writing. Now that I have brought

it to their attention they are only willing to credit me for the past 90

days of wrongful charges. Although I admit that I did not look closely at

my statements (stupidly blind trust, I admit), does this situation warrent

looking into filing a suit? If this is not actually a lawful charge on their

part (they have admitted their error insofar as they will be crediting me

for the past three statements' charges), and if it can be shown that they

have been levying this fee on other unaware customers, can and should

this be persued as a class action suit? Thank you for your assistance.

You DO have a potential lawsuit against your bank. Additionally, it is possible to bring suit on behalf of the public if they are doing this to others as well, i.e., just charging people these additional service charges without informing them.

This may be a class action law suit. However as for you individually, you can sue in small claims for the past 2 years.
