Legal Question in Credit and Debt Law in California

7 year old phone bill

I recently received a notice from a collection company that I owe 400 dollars for an old LAN line phone account I used to have about 7 or 8 years ago. I have very good credit and I have also seen my credit report two or three times during this 7 or 8 year period and this account is not on my credit report at all. This is the first notice from this collection company. What should my next steps be? Thank You.

Re: 7 year old phone bill

If the debt is 7 or 8 years old, you should not do anything. The statute of limitations has expired and you could potentially restart it if you do the wrong thing. If you want to do something, you can send them a letter asking for verification of the debt, but be careful you do not restart the statute of limitations.

The statute of limitations could either be four years or two years from the date of any breach by you. You may have a case under the Fair Debt Collection Act to sue the collection agency. Please contact me if you have any questions.
