Legal Question in Credit and Debt Law in California

accident no insurance

My husband is being sued for an accident where he hit a parked car and didn't have insur. They're asking for $14,000. He--name removed--been layed off for a month so he--name removed--not working now. Is there a way to get this amount lowered? And set up payment plan? His name is not on house. Can they come after me? Are'nt they double dipping? The parked car he hit was insured. Why is'nt there a max amount if there was no one hurt?

Re: accident no insurance

First, it is probably the insurance company suing your husband.

Second, you may be able to set up a payment plan.

Third, there is no double dipping. The insurance company paid out and they are entitled to recover their payments from the at fault party.

Fourth why should there be a maximum amount? If your husband had caused $100,000 in damage, they would sue for that amount. This is why you are required to carry insurance.

Fifth, they may be able to put a lien on the house, depending on its status. You may need to consult with a bankruptcy attorney.
