Legal Question in Credit and Debt Law in California
Account sent to collection agency wrongfully
My wireless carrier did not carry his promises out and accepted my challenge to cancel my contract if he keeps giving me empty promises. I did cancel my contract within a month after I signed up for services and now he sent my account to collection agency. Can the Law help me on this case? It is unfair for me as the consumer and it is not right that consumer signs a contract and the merchant can give a lousy service or bad job.

Re: Account sent to collection agency wrongfully
A contract like this is a bilateral contract, which means both parties must perform. Many cellular companies forget this.
Reply to the collection agency with a detailed list of who you spoke with, what was promised, and any correspondence. Tell them you are disputing this because the cellular company breached the contract first, by failing to deliver service.
Usually, they return it to the carrier, who then drops the matter.
