Legal Question in Credit and Debt Law in California
What if the amount on the complaint is incorrect? Is it still a legal form in court or will the judge just overlook it?
1 Answer from Attorneys
The demand in the complaint is just an allegation. As such, your response to the complaint should be that the amount demanded is not correct. The court will determine who is right through either a trial or some pre-trial case-determinative motion, and will award damages accordingly. Yes, the complaint is legal (i.e., meaning you must respond to it).
