Legal Question in Credit and Debt Law in California

Answer from Melvin Belli was to contact legal aid in bay area or local.This was my first approach Months ago.No one seems to handle card problems. Still in need of some information..Since my last request I find weekly letters of them telling me that they have different payment plans and are really playing dumb and avoiding my offer of A minimum payment each month as was advised by legal guru.

This all started 9/1/09 and it appears to me as a stall for what reason was my question,I am single,80 years young,a renter withno assets living on social security.Ihave made an offer to each card company and the bottom line is that I have nothing.This is my third request.

Ok James, it would have been nice to know that before I gave you that advice but I beg to differ with you as I volunteer for the San Francisco Bar Associations Volunteer Legal Services Program . They do credit card issues as we have resolved several credit card matters for them.

So back to your problems. First are you making any payments? If you are not at some point typically they will contact you with some sort of special offer to reduce the amount owed if you will pay them off.

Also has any of them filed suit yet? If they file suit then please make sure you file a response in a timely manner. Since you don't have th money to pay for the filing you can apply for a fee waiver. They have those forms at the clerk's office.

The other thing you can do is send all your creditors a snap shot of your finances including who all you owe money to and include a ballot that states what you would be willing to pay each one with an indication that if they don't accept you will file bankruptcy. They should appreciate they are quite likely to get less or nothing if you do file bankruptcy. This is what some of the credit card debt settlement companies do.
