Legal Question in Credit and Debt Law in California
Appealing a default judgment
Can I Appeal a default judgment against me for the balance of auto loan after it was reposessed? I didn't know that I was supposed to respond, I just went to court on the date it had to appear. But they had already won a Judgment by default, and now are garnishing my wages.

Re: Appealing a default judgment
You can bring a motion to vacate the default due to your inadvertence and excusable neglect. If you are successful, then you can argue the case in court. The defenses to a deficiency lawsuit include breach of warranty, breach of the disclosure laws, and failure to give proper notice of sale. I have handled several of these cases. You can email my office to set up a consultation.

You may have time to set aside the default judgment and negotiate a reduced settlement with payments. Call me directly at 6192223504.
