can third party debt collection agengy sue without proof of my signature on the original contract?

Yes, they can sue. But, they will have a difficult time proving their case, if you know how to fight it. You should read my blog at www.californiadebtblog.com for more information. You need to aggressively defend this case.

Without a signature, instead of a 4 year statute of limitation, there is a two year if in fact, the debt is yours. If the debt is not yours, you may have a claim against the collection agency if it still pursues you after a requested verification of the debt.
