Legal Question in Credit and Debt Law in California

Assign debt to third party?

Any one had any luck with any of the firms to which you assign your judgment, and then they get a piece of the action only if they collect. They employ PIs (and attorneys, I think, as neeed) and what not and claim to be a lot more agressive and resourceful than collection agencies. Amount in controversy is $250K but limited funds to pay hourly to have it collected by an attorney.

Re: Assign debt to third party?

There is no need to assign or sell the claim. Even if you cannot pay any costs, you can structure the placement at a higher rate than normal. But costs are not that much, unless you are pursuing forced sale of homes and recorded examinations. Typical post judgment enforcement costs are $400 - $800.

A decent collection law firm can likely handle the case for you; and that way, you cut out the middleman.

Re: Assign debt to third party?

I would agree with Mr. Guerrini's estimate of the basic post-judgment costs. There is no need to assign your rights to a third party. An attorney working on your behalf can get the same results hiring the same investigators and perhaps give you a better rate.

My contingent fee rates generally range from 25%-40%, so feel free to contact my office for a complimentary consultation.
