Auto Insurence Refuses to Pay; Am I Required to Pick up the Bill?
If my full coverage auto insurer authorized repair and then refused to pay, am I liable for any amount beyond my deductible? We have been put into collections by the auto body shop who attempted unsuccessfully (for 8.5 months) to repair my crashed car. My insurance company did not believe the estimates that were provided were indicative of the actual work that had been accomplished. (After 8.5 months, the auto was deemed a ''total loss'' because somehow a torn frame was overlooked the whole time)Therefore, the insurance company refused to pay for the estimates until more concrete receipts were provided. None were provided to the insurance company or me...instead, the auto shop sent me to collections. I would like to know if, since I never approved any work estimates or orders personally, I am liable. The documents that the collection agency sent us as proof as to why we owe the mechanic are unsigned estimates and notes from the mechanic stating that my insurance company did not pay him his money. In my mind, the documents do not prove that I owe him the money that my insurance company denied him. Unfortunately, the collection agency feels different. I need to know how the law sees the situation.
