Legal Question in Credit and Debt Law in California

Auto shop witholding car

Here is the brief story: I bought a mustang. I allowed someone to drive the mustang for about 6 months while taking over the payments. No paperwork was done with him, it was just a verbal agreement. He drove the car and made the payments. The whole time the bank had/still has the lien hold since the car is not paid off. He got into an accident without insurance and took the car to a body shop. Then he left town and I can not locate him. I've found out where the car is located, but the body shop wants to charge $3000 in storage fees before releasing the car to me. Am I obligated to pay these storage fees, even though I (the owner) did not authorize any repairs or sign anything? If I am not required to pay the storage fees, how can I take action to have the car released to me?

Re: Auto shop witholding car

Once you pay the storage fees on the car that you foolishly lent to an irresponsible individual without even getting anything in writing, should be no problem getting your car back.
