Legal Question in Credit and Debt Law in California

Automobile Non-Export

If a person purchases a vehicle under their name or company and signs a non-export agreement with a term of 1 year. Is this agreement enforceable if the vehicle is later sold and the ''New owner'' exports the vehicle. I/we don't have any control what the new owner will do with that vehicle.

Probably not enforceable, as the contract is not a "covenant" that goes with the car, it is simply an agreement between the two original parties. If the agreement does, however, provide that it is binding upon successors in interest, heirs, etc... then one might have a claim against the first buyer who violated the agreement by selling to another party without making them aware of this non-export agreement, but the successive buyer is most likely not liable unless you can prove that he/she/it had actual knowledge of the agreement and violated it.
