Legal Question in Credit and Debt Law in California

Back on 1/22/10 I received a complaint and summons filed by Capital One Bank. Not knowing what to do I called the creditor and tried to negotiate a payment plan but unfortunately that did not work since I had no job and the money they wanted was something I could not come up with. With that said I haven't done anything about this since I am still unemployed with no money. I recently read an article about people being jailed for their credit debts so I decided to look my case up online. I found that that a "Request for Entry of Default" filed by Capital Bank was filed on 04/08/2010. I am not sure what to do at this point since its been quite sometime and I haven't done anything about this. I would appreciate any advice to try and resolve this matter.

If a judgment is not yet on file, and no default has been entered, you can still file your answer. That would put you in a better position to negotiate with the attorney for the creditor.
