Legal Question in Credit and Debt Law in California
Bank of America Capital Mgmt
I have stated to this company that I would pay them $20 a month until paid in full but they still want to take me to court. The lawyer said that his client had his right to a court.I said if I agreed to pay each month Why!''To Show Me Up As Being Poor'' and he said ''Well You Are Poor'' then he hung up on me.
I am on disability, raising a great-grandchild and money is tight.I don't need to be treated thatway no one does.I am willing to pay them why continue with this matter! They are wasting the courts time and money, the lawyers time and money just to harrass poor people

While I will agree that no one should be treated disrespectfully, if you owe a creditor money and you haven't paid it, your creditor has every right to sue you in court. While it may seem like a waste of time and money to you, suing people is sometimes the only way creditors can ever collect their money. Moreover, once a creditor is owned money, the creditor has a specific period of time within which to sue, and if suit is not brought, the creditor looses its rights against the debtor. While I am sure you are honorable and truly intend to repay the debt, many, many people are not so honorable, and the only way creditors can obtain their money is by obtaining a judgment before the statute of limitations expires.
