Legal Question in Credit and Debt Law in California
Bank Levy and Judgement
Couple of months back I had my checking account levied from a creditor with a judgement. I filed the claim of exemption and fought against it, but the judge eventually allowed the creditor to take that money.
Is it possible now that they could enforce another bank levy on the same account or another account at a different bank?
Thanks.
Tony

Re: Bank Levy and Judgement
Yes. You might take steps, though, to minimize your exposure.
Also, there's nothing to prevent you from again seeking the court's intervention and proving that you deserve the exemption or, at the very least, to have the levy reduced.
Further, you might contact the attorney for the creditor and make payment arrangements. You might even be able to agree to a discount if you pay a lump sum.
