Legal Question in Credit and Debt Law in California

Bank Levy

I have a a bank account I share with my 17 y/o Son who is named as the Primary Account Holder for this Savings account. The Bank received an order for Levy due to the credit card debt I owe. Since my Son is not part of any of my debts can he file for exemption?

A 17 year old is not supposed to have an account in his name. Therefore, you can tell the court that the money is his and your name is on the account as trustee or custodian for your minor son assuming that is true. If the money came from his job or another source that shows the money is his then you should present evidence of that to the court. Otherwise it will look like you are hiding your money in your son's name to prevent your creditors from taking it.
