Legal Question in Credit and Debt Law in California

No Bill for a Year

Hello,I had moved in September of 04. I called all of my credit card companies and provided them with my new address. One credit card company inputted the wrong ZIP code. It's been a almost a year and then yesterday I receive a call from a collection agency stating that I'm in collections.I called the credit card company and they were very rude telling me that I should have called them. I tried to explain that I never use the credit card(its in my drawer)therefore I was not even aware of it.They also told me that the monthly statemeny is a courtesy that they provide to the consumer to be nice.My questions are as follows;Do they have a right to put me in collections when they could not get the address correct? What about my credit report,do they have to fix it?Please help I'm at my breaking point.

Re: No Bill for a Year

we can appreciate and empathize with your frustration immensely. we have helped hundreds of persons just like yourself who are "fed up" with the questionable practices of creditors, to say the least. here, the creditor absolutely has a legal duty to validate your debt, especially upon your request for such validation. however, it is arguable whether or not they have a legal duty to send you monthly statements or not to initiate collections based on what clearly seems to be a valid "misunderstanding". your best bet here would be to negotiate a mutually beneficial settlement that you both can "live with". our law firms specializes and excels in this area of the law. if you would like further assistance, contact us directly today.
