Legal Question in Credit and Debt Law in California

I bought and paid for a 2007 Rav4 almost 4 months ago. I have the registration and pink slip. The Toyota dealer just sent me a certified letter stating that I owe an additional $205.10 in sales tax that they miscalculated. No proof was offered. Do I have to pay this bill?

I disagree with Joe.

I would say no - the contract was prepared by the dealer. The dealer has a computer that controls the information on the contract. The dealer performed the calculations and accepted your money. I would assert that it is an unfair business practice to ask for the money. Let the dealer take it out of its profit. It might be a different issue if the amount were for registration fees.

Of course, as an attorney I would have to see all of the documents before I could give a difinitive opion. However, in my dealer fraud cases I beleive that no money is due.

Good luck,
