Legal Question in Credit and Debt Law in California

my now ex boyfriend whom is now in jail for burglary and breaking a restraining order i had on him multiple times had made a fraudulent payment to a cell phone contract in my name that i was unaware to be fraudulent. now two months later that payment has been returned and added back to the cell bill. now I have two days to come up with the money. do i have any rights in the matter or am I just screwed?

Not sure how that makes you screwed. You still just owe the cell phone company the same as you always owed them. Just because you thought your ex paid it for you doesn't mean you don't owe the money if he didn't. You just owe the money for your bill like anyone else.

I assume the charges on the cell phone are properly yours. If so, then you have no rights against the phone company. If your former boyfriend incurred those charges, you also likely have no rights against the phone company.

You may have rights against your former boyfriend, but I would be surprised if those rights were worth pursuing.
