Legal Question in Credit and Debt Law in California
Bring suit against collection agency
A collection was brought against me by a dentist who could not provide proof he provided a service. He refused to produce an itemization or insurance codes for $2365.25. He was paid for what he itemized and coded. I think this was an attempt to pad his bill. Can I bring a suit against him or the collection agency for fraud to clear my credit record?

Re: Bring suit against collection agency
Respond to the collection agency by certified mail. Advise them that this is a disputed/constested account, and that you demand all rights provided by the Federal Fair Collections Practices Act.
They must verify the debt and provide you with a statement of the account within 30 days.
Write to the collection agency again by certified mail if you are correct in your position, and request that they include your letter in your credit file and to any creditor inquiring about your credit rating to ensure that your side of the story gets told.
