Business customer's ask do not deposit check but give no answer when fund will b

My company has a customer who owed us around $35,000 and write a company cehck due on 9/15/03.

1. He asked us do not deposit check beacuse no fund was available, but just said would give us a proposal with no time frame what he would do.

2. His business is still operating and we think he just try to deceive us.

3. what should my company do? if we deposit check and NSF, what leagl options do we have to get money?

I think this customer is playing games with you. I would immeidately file a lawsuit against him and go to court for a pre judgment attachment. To keep good customer relations you may wish to notice him that you will deposit the check after a designated amount of time, i.e., 30 days. Once it is returned NSF you have civil and criminal options to collect. You may file suit or refer the matter to the District Attorney. Or you may refer the matter to an attorney immediately.
