CA Credit Card Debt Vs Court Judgment

Credit Card Debt was assigned to ex-

husband during divorce in family law

court. Ex has defaulted on debt. Can

the credit card company hold me

responsible for the debt?

If you are a co-obligor on the credit card, yes. If the debt is large enough you may need an adjustment of the division of the marital community in the judgment of dissolution. Otherwise, you may end up having to sue him for indemnity for any amount you have to pay to settle with the credit card co.

The credit card company can hold you liable for any card or debt you signed for, regardless of the divorce decree.

The divorce merely orders your ex to pay the debt. However, it does not affect any original liability you may have to the credit card. In other words, the court's judgement does not extinguish the contract with the credit card company. If you signed as an obligor for the credit card, you are still bound by the contract you signed. The court can hold your ex in contempt for failing to obey the court's order.
