Legal Question in Credit and Debt Law in California

I am a california business that sells equipment at retail and buys from a distributor at wholesale. One distributor would charge me a 3% fee for paying by credit card and says that it is legal at the wholesale level although not at my retail level. Is this true?

Yes. Between merchants it's whatever terms you can negotiate. Maybe the distributor will extend you credit, which presumably would not carry a credit card processing fee.
