Legal Question in Credit and Debt Law in California

Car co-ownership

I co-signed for a car loan with my ex, who has the car and is making payments, although is late frequently. If I pay off the loan myself, remove him as co-owner (which the DMV told me I could do), then can I report the car as stolen and get it back so I can sell it?

Re: Car co-ownership

You would be filing a false police report, because the car is not stolen ... she is driving it with your permission.

You would take the place of the lender, and would be able to repossess the car using a reposession service, provided she was late, etc.
