Legal Question in Credit and Debt Law in California

Car Loan Deb - Car has been repossesed

Hi, my mom purchased a loan for my brother, he never paid the payments and my mom isn't able to pay the payments either. The car has been repossesed, but she is getting harassing phone calls both at home and her work by a lawyer. What are her options? What can she do? He is harassing her everyday and calling her at her job.

She can and should tell him not to call her ever again. He can write, he can sue. Just don't call. To do so after such notification would violate the Fair Debt Collection Practices Act.

She should send them a letter and tell them not to contact her anymore. She will probably be sued. You should go to the NACA website and find an attorney to help her for the soon to come lawsuit.
