if the case is set for CMR in 02/17/10 when should I file a Discovery ? Do I need to pay a filing fee for this?

Discovery is not filed. Do it whenever you want, as long as it is completed at least 30 days before trial.

I would have rejected this question for insufficient facts. You didn't say what kind of case or whether you are the plaintiff or defendant, in any event you would pay only one filing fee. If the CMR was 2/17/10 you missed your court date by 7 months.
