Legal Question in Credit and Debt Law in California

Charge Off / Judgement

I got behind on one of my cc. They charged it off in 11/01. I was still making payments until the auto payment stopped in 2/02. Now a 3rd party collection offered a settlement amount, which I can not afford. They said if I do not accept it. They will send it to have a judgment issued to me. I own a home, I am worried that there will be a lien on my property or I might lose it. What can they legally do to me, i.e., lien, garnish, etc. The debt is $14k. What options do I have?

Re: Charge Off / Judgement

You really have no choice except to fight any lawsuit prior to a judgment being entered and making a settlement prior to trial. Even if there is a judgment entered, there is a Motion before the Court that may allow you to make payments that you can afford. It may be best to have an attorney review your documents and facts and help you make a settlement. If you fax me your documents to 714 363 0229, I will provide you with free consultation and let you know what I would charge to represent you.
