Legal Question in Credit and Debt Law in California

Civil Judgment

Back in 2001 a civil judgment was awarded to an insurance company against me. The insurer had to pay out to its client to cover money I admitted to misappropriating. Six years later, with no notice or warning, they seized my checking account. I negotiated some of my money back and agreed to pay $300/month. But I have since lost my job. I can not pay them until I find employment. There is no money in my account for them to seize. My car is worth no more than $3,100. I have an old VW Bus worth maybe $2,500. Their lawyer is rude and has not replied to my correspondence on this point. Can they take my car(s)? I am scared?

Re: Civil Judgment

They would need to get a writ first. If they can specifically identify the car, then they could try to seize it. You would need to file a claim of exemption. You may want to talk to an attorney to make sure your claim is filed properly.
