Legal Question in Credit and Debt Law in California

Can I collect on court judgment for wages if company is ''suspended'' but office

I was employee of a corp. that closed its doors owing

me $11,000. They did not dispute the amount, but said

they had no money. The corp. has not gone bankrupt,

but is listed as ''suspended.'' The President & founder

went on to start a new LLC. I went through the labor

dept., but that president claimed I was an independent

contractor, and I was decided against. I appealed the

decision, and won a default judgment (against the

corp). Labor dept. says I don't need them, because of

the judgment. Can I use the judgment to collect from

the President at his new company?

You may be able to hold the indivudual officer's and shareholders liable if the corporation is suspended. Our office provides free consultation.

Yes. You can use the judgment to lein the house, garnish wages and encumber any number of things depending on who the judgment is against. I suggest you hire a collections attorney or read up on judgment enforcement techniques. Good luck Martin.
