Legal Question in Credit and Debt Law in California

Collecting for Carpets

We have recently moved out of our apartments and now we are receiving a notice from thier lawyer stating we have to pay for carpets to be cleaned. We stayed there for about 3 years. Is there any law stating that carpets must be changed after a certain amount of years?

Re: Collecting for Carpets

There is no law that I am aware of stating how often carpets must be replaced in a residential unit. The law states that the tenant is responsiable for all damages above and beyond "normal wear and tear".

Like beauty, "normal wear and tear" is in the eye of the beholder. I would right the attorney back to dispute the request and demand to know what evidence they have that your use was beyond normal wear and tear. If the press the claim, contact a local attorney for further assistance.

Unless there is an agreement to the contrary, you do not have to pay for normal, reasonable wear and tear.
