Legal Question in Credit and Debt Law in California

Collecting a personal Loan

I made a personal loan for a considerable amount to my friend. The ONLY proof I have is a copy of the check I wrote to him. In the memo line of the check, I had written ''Loan to friend's name''.

Now my friend refuses to give me my money back. Is there any way I can get him to pay back my money?

Appreciate any help.

Thank you very much.

Yes, there is a way to get the money back. It is called a lawsuit.

Re: Collecting a personal Loan

You can sue and get a judgment against him. It's something you should do soon if you want to, because if you wait the time to sue may run, or you may have the court tell you that you waited too long to sue ("laches").

If the amount is under $5,000, you can sue in small claims court. Above that, you'll probably need a lawyer.
