I was recently issued a court summons from Palisades Collection LLC represented by Wolpoff & Abramson the debt they are trying to collect on is about 8 years old ( a car loan originating in Illinois)
This is what the Cause of Action states
Plantiff alleges the defendant (Me) became indebted to the plantiff within the last 4 years because an account was stated in writing by the between plantiff and defendant in which it was agreed that the defendant was indebted to plantiff
I never signed anything with them. What would you suggest I do?

File an answer to the complaint within 30 days of its service upon you. Make sure to raise an affirmative defense of statute of limitations, that the debt is not owed, that the debt is overstated, and ask for attorney's fees as well as costs. Or, depending on the amount in question, see a lawyer who can help you out for a small fee. The statute of limitation for such a debt is generally 4 years from when the last payment was due but was not paid.
