Legal Question in Credit and Debt Law in California

Collection Agency trying to collect old debt

I received a letter from a collection agency stating that they purchased my Ballys Fitness account and requesting that I pay my debt. This is a 11 year old debt, that has been out of my credit report for a while now. Do I have to pay them? Should I respond to their letter? What should I say?

Thank you very much for your very helpful website.

Sincerely,

Renata

Re: Collection Agency trying to collect old debt

No, you don't.

There is a 4 year statute of limitations on a written contract, and they cannot make any reference to your credit report.

Send them a letter telling them not to bother you again, and if they do, you will file a complaint with the proper government authorities.

Re: Collection Agency trying to collect old debt

The statute of limitation on a written contract is 4 years from the date of breach for most purposes. If the collection agency is seeking a debt passed the statute and you have it in writing, you may have a lawsuit against the collection agency. Please fax me any letters you have to 714 363 0229, and I will provide you with free consultation.
