Legal Question in Credit and Debt Law in California
Collection agency purchases 10 year old account; reports it as 2 year old debt
No one has a straight answer for me. Collection agency purchased 12 year old chiropractic account and reports it on my credit report last year as a 2004 account. No action on account ledger since July 1994. Collection agency refuses to remove from credit report. Credit reporting agency ignored my last dispute letter. What can I do?

Send letters to all 3 credit reporting agencies disputing the debt. You might want to send them certified-return receipt to make sure they got it. Also, write to the chiropractor telling him/her that she's responsible for the error on your credit report. If you have tangible evidence that credit costs you more because of it or you have been denied credit -- i.e. on a mortgage -- then you might be able to take some legal action once you have done everything else.

Although I concur with Mr. Cohen's advice, I would add that the collection agency has alreayd violated the Fair Debt Collection Practices Act. You already have a claim for money damages.
Get a free copy of your credit report and www.annualcreditreport.com. You can download copies of all 3 credit reports from that website. They will have instructions on how you can dispute innaccurate entries on your credit history. Send all letters with a method that allows you to confirm delivery.
