Legal Question in Credit and Debt Law in California

Collection

I received a letter today from a collection agency. I did not recognize or even remember having an account with this company. I phoned the collection agency and they said it was a debt from May 1992. This was more than 15 years ago. What should I do or do I need to pay it?

The statute of limitation bars collection. Tell them not to call again, that you're not going to pay it.

It appears that not only is the debt passed the statute of limitations, but you may have a case against the Collection Agency under the Fair Debt Collection Act. We would have to review your letter in order to determine your rights. Please contact us Monday morning and we may be able to stop further abusive letters.
